Welcome to KubeFlex! These Terms and Conditions (“Terms”) govern your use of our services. By accessing or using our services, you agree to be bound by these Terms.

1. Overview of Services

KubeFlex is a community-driven company that assists startup companies in building their technology stack. We offer three tiers of services:

1.1 Free Tier

• Service Description: KubeFlex assists startups in securing cloud credits from popular providers like Azure, GCP, and AWS. Note that Kubeflex is not responsible if the application for cloud credits is rejected.
• Platform Build: Once cloud credits are secured, KubeFlex will build an end-to-end cloud-agnostic, cloud-native technology platform on Kubernetes at no cost. This platform follows best practices, including a scalable microservice architecture.
• Documentation: Upon completion, we provide the necessary documentation and guidance for the startup to manage the platform independently. This marks the end of our free service engagement.
• Queue System: Startups requesting free services are placed in a queue. We serve one startup at a time, moving to the next request upon completion.

1.2 Paid Tier – Platform

• Priority Service: Startups can bypass the queue by becoming a paid customer, receiving immediate attention.
• Custom Needs: Paid customers can specify custom requirements for their platform.
• Ongoing Maintenance: KubeFlex provides ongoing maintenance of the platform after the initial build, ensuring its continuous operation and scalability.

1.3 Paid Tier – Platform + Development

• Service Extension: In addition to the services provided in the Platform tier, KubeFlex offers application development assistance.
• Comprehensive Support: This tier includes both platform maintenance and application development, tailored to the startup’s specific needs.

2. Payment Terms

• Free Tier: The Free Tier is provided at no cost to startups.
• Paid Tiers: Pricing for the Paid Tier – Platform and Paid Tier – Platform + Development will be outlined in a separate agreement, including details on custom requirements, payment schedules, and maintenance fees.
• Non-Refundable: All payments made to KubeFlex are non-refundable unless otherwise stated in the specific service agreement.

3. Limitations and Disclaimers

• Cloud Credit Application: KubeFlex does not guarantee the approval of cloud credit applications. The startup is solely responsible for the outcome of their application.
• Limited Liability: KubeFlex is not liable for any damages or losses resulting from the use of our services. Our liability is limited to the amount paid by the startup for our services.
• No Customization in Free Tier: The Free Tier does not include customizations. Startups must accept the platform as provided by KubeFlex under this tier.

4. Termination

• Termination by KubeFlex: KubeFlex reserves the right to terminate any service at any time if the startup violates these Terms or engages in activities that could harm KubeFlex’s reputation or operations.
• Termination by the Startup: Startups may terminate their engagement with KubeFlex at any time by providing written notice. However, no refunds will be issued for any prepaid services.

5. Confidentiality

• Data Protection: KubeFlex will not disclose any confidential information related to the startup’s business or technology stack without explicit consent, except where required by law.

6. Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].
